The Ministry of Agrarian Policy and Food of Ukraine developed and published the additional criteria for booking the employees of agricultural companies. These criteria are set out in the relevant order No. 223 dated February 21, 2023. However, please note that the list of businesses eligible for the relevant criteria includes not only agricultural ones but also warehouse entities, sellers of agricultural goods, plant protection products, seeds, machines, fertilizers, as well as producers of the above, food and beverage producers, and fish farms.
Thus, the Ministry approved the following criteria:
1. Treatment of land with the area over 1,000 hectares or at least 50 employees.
2. One of the main company activity types as of January 1, 2022, is listed above.
Thus, if the company fits both of these lists, it automatically fits one of the criteria of an enterprise critical for the economy and livelihood of the population during the special period in accordance with the regulation No. 76 of the Cabinet of Ministers of Ukraine dated January 27, 2023.
According to this regulation, a critical company is an entity that fits any of the three criteria. Thus, if a company fits the criteria of the Ministry of Agrarian Policy and Food of Ukraine, it also needs to fit any two criteria of the regulation.
The following two are the most feasible for small enterprises:
1. absence of single tax debt within the mandatory state social insurance
2. the salary of the insured employees at the enterprise for the last calendar quarter totals at least the average salary in the region in Q4 2021.
Hence, if a business fits both criteria set by the Ministry of Agrarian Policy and Food of Ukraine and two criteria of the regulation of the Cabinet of Ministers, it can be deemed critical for the economy, consequently, be eligible for booking of 50 % of the registrants and additionally a director and deputy directors.
In this case, the enterprise shall appeal directly to the Ministry of Agrarian Policy and Food. We also recommend the following: not to waste time, submit both appeals, on being critical for the economy and on the booking. It can significantly reduce the booking registration time.
