Confirmation in court of VAT refund for grain exports

Another winning case on VAT refund for a grain trader (client).

This time, the amount of unreasonably unconfirmed tax credit amounted to more than UAH 9,000,000, but the court of appeal upheld our position.

However, winning this case does not mean that the client will receive a refund, as practice shows that the tax authorities may not comply with the court decision for months after it enters into force. Therefore, in this situation, we filed a lawsuit in advance to recover the funds in question.

In the near future, we will also describe the novelties of court practice and actions of the tax authorities regarding the non-confirmation of the export grain VAT credit, which may lead to a review of certain processes in your company or to changes in the terms of contracts, such as transshipment.
